What at-will means
At-will employment generally permits either party to end employment, subject to legal restrictions and applicable agreements. It does not permit unlawful discrimination or retaliation, or cancel a notice obligation that applies to a particular termination. The Texas Workforce Commission's overview is a Texas example, not a rule for every state.
Receipt wording and contractual promises
A receipt statement can identify the handbook, version, employee and date. Keep any intended disclaimer consistent with the handbook's policies and other employment documents. The Texas Workforce Commission's disclaimer guidance explains the purpose of disclaimers in that jurisdiction. No single substitution of “acknowledge” for “agree” decides enforceability everywhere.
Promises about permanent employment, discipline steps or notice deserve review in the context of the whole document. Have employment counsel review the wording for the places where your employees work.
Keeping a useful acknowledgment record
- Identify the employee and the exact handbook version delivered.
- Keep the delivery date and the acknowledgment record together with that version.
- Record a refusal accurately; do not describe a refusal as a signed acknowledgment.
- Document distribution of important updates. Confirm any signature or notice requirements for the particular policy.
- For electronic delivery, preserve evidence linking the recipient, version and date.

- Does signing an employee handbook make it a contract?
- The legal effect depends on the full wording, other promises and applicable law. An acknowledgment can document receipt without intending to create a contract, but a disclaimer or a particular verb does not guarantee that result.
- Do employees have to re-sign after a handbook update?
- Recording receipt of important updates is useful version control. Whether a new signature or particular notice is required depends on the policy and applicable law; it is not a universal rule for every edit.
- Does an acknowledgment create at-will employment?
- A receipt alone does not establish the governing employment terms. Applicable law, contracts and the surrounding facts determine the relationship.
- What if an employee refuses to sign?
- Provide the handbook, record delivery and the refusal accurately, and ask HR or counsel how the policy and local rules apply before deciding on further action.
- Is an electronic signature enough?
- Keep evidence linking the person, document version and date. Whether the electronic process is legally sufficient depends on the applicable requirements and the record it produces.
